What is a guaranteed home sale, and what's the catch?

By Kurt Hayley and the Local Experts team, Opelika, Alabama

A guaranteed sale is a written commitment from the broker: if your home doesn't sell within an agreed time, the broker buys it. Kurt Hayley offers it on homes across Lee County. Here is how it works and what the conditions are.

How it works

  1. Kurt reviews your home and the recent sales around it.
  2. You and Kurt agree on a guaranteed price and a possession date. Both go into the written agreement.
  3. The home is listed and marketed to the open market, usually above the guaranteed price.
  4. If a buyer closes before your date, you keep the result of that sale.
  5. If no buyer has closed by your date, Kurt buys the home at the guaranteed price.

The conditions

The asterisk matters, so here it is in plain terms. The guarantee only exists once you and Kurt have agreed on the price and the possession date. If you can't agree on those, there is no guarantee. Terms and conditions apply, and they are spelled out in the Professional Service Agreement before you sign anything.

Why a broker would offer this

Because he rarely has to buy. The same team sells more than a hundred homes a year in this market using a 21-point marketing system, and Kurt has spent his career buying, renovating and reselling property. He can price the risk because he has done it with his own money.

Questions to ask any agent offering a guarantee

  • What is the guaranteed price, and how was it worked out?
  • What date does the guarantee take effect?
  • What do I have to do to keep the guarantee in force?
  • Can I cancel the listing if I'm not satisfied?
  • Can I see the full agreement before I commit?

Kurt will answer each of these in writing.
